Using Eros³
These Terms of Service ("Terms") govern your use of eros3.ai (the "Service"), operated by EtherFun Lab ("we", "us"). By creating an account, signing in, or otherwise using the Service, including the anonymous demo, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
These Terms are published in English, Simplified Chinese, Traditional Chinese, French, Spanish, Portuguese, Russian, German, Japanese and Korean. If the versions differ, the English version prevails.
1. Eligibility
You must be at least 18 years old to use the Service. By using it you represent that you are 18 or older, have the legal capacity to enter into these Terms, and are not barred from using the Service under the laws of your jurisdiction. Age is self-declared during onboarding.
2. What Eros is
Eros³ (hereinafter "Eros") provides AI-driven companion characters you can chat with by text, voice and images. Each companion is a software construct, not a real person. Replies are generated by AI and may be inaccurate, inconsistent, or unsuitable for any particular purpose. The relationship state shown in the app reflects internal state of the companion and is not a measure of any real-world quality.
Eros is not a substitute for human relationships, medical advice, mental health treatment, legal advice, or any professional service. If you are in crisis, please contact a qualified professional or a local emergency service.
3. Your account
You can sign in with Google, GitHub, an email one-time code, or a Solana wallet. Creating a new email account may require an invite code. The anonymous demo gives limited access without an account; if you later sign in, the demo conversation may be carried into your account.
You are responsible for activity under your account and for keeping your sign-in credentials, wallet keys and linked accounts (including Telegram) secure. One person may not operate multiple accounts to obtain extra allowances or rewards. Notify us promptly if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to facilitate illegal activity.
- Submit or create content that sexualizes minors, depicts non-consensual acts, or otherwise violates applicable law. This applies to every character, including private ones.
- Upload photos of, or create characters depicting, real people without their consent, or use the Service to produce deceptive imagery of real people.
- Create characters, avatars or voices that infringe someone else's intellectual property or personality rights.
- Harass, threaten, or attempt to identify other users.
- Probe, scan, scrape, reverse-engineer, or interfere with the Service or its underlying systems, or circumvent content filters.
- Bypass rate limits, abuse free allowances, invite codes, promo codes or referral rewards, or use automated tools to interact with the Service without our written permission.
- Use character bots on Telegram to send spam or unsolicited messages.
- Impersonate any person or misrepresent your affiliation with anyone.
- Use the Service to train competing AI models without our express written consent.
We may suspend or terminate your access if we reasonably believe you have violated these rules.
5. AI-generated content
All AI-generated content on the Service, including but not limited to text, voice, images and video, is fictional creative work featuring imaginary characters. No AI character exists in reality. Every character, whether portrayed as a human or as a fictional species, is depicted as an adult by the standards of every jurisdiction. Virtual items, their effects, and the needs, body states and life events of characters are part of this fiction (Section 7).
Companion replies, images, videos and voice are produced by AI and may contain errors, inappropriate statements, or fabrications. You should not rely on companion output for factual, financial, medical, legal, or emotional guidance. We do not warrant the accuracy, completeness, or suitability of any AI-generated output.
The Service permits mature or sexually explicit content ("adult content") in private companion chats. Adult content is an intended product feature, but it is intended to be lawfully produced, stored, and delivered. Whether adult content is available in a given chat depends on the character's settings, your account settings, and your plan; some adult capabilities are available only on a paid plan. Adult content is not shown to the public or to the anonymous demo, which applies a content filter, and is available only to signed-in account holders who have represented under Section 1 that they are 18 or older.
Content is generated by AI models operated by us and by our vendors, whose own content-safety and legal-compliance policies apply. We operate with reference to the content-standards norms of the jurisdiction where our infrastructure and data are hosted, as well as applicable law generally. We do not knowingly generate content unlawful to produce, store, or transmit. Nothing in this Section limits Section 4: content that sexualizes minors, depicts non-consensual acts, or is otherwise unlawful remains prohibited regardless of any vendor's rules, and we may filter, block, or remove it and suspend the responsible account. We do not warrant that filtering is error-free or that adult content is lawful in every jurisdiction from which you access the Service; under Section 1, you remain responsible for ensuring your use is lawful where you are located.
6. Points, payments and tips
Eros Points are a virtual currency used inside the Service. You can obtain points by purchasing them with cryptocurrency on the Solana network, by redeeming top-up cards or promo codes, through invite rewards, and from sales of characters you publish. Each account also receives a daily free allowance that resets every day. The current prices, the cost of each action and the allowances for each plan are shown in the app and may change; the in-app usage page is authoritative.
Points have no cash value, are not money, stored value or property, cannot be transferred between accounts, and cannot be redeemed for cash. Some points expire; expiry is shown in the app. Purchases made on-chain are final once broadcast.
We may offer paid plans. What a plan includes, and its price, are shown at the time of purchase. We may change plans and allowances; changes apply from the next billing period or as announced in the app.
Points are non-refundable once credited to your account, whether you bought them, received them as a gift or reward, or earned them; purchased paid plans and memberships are likewise non-refundable. We make an exception only where applicable law requires a refund, and handle such requests case by case through the email address in the Contact section.
Top-up cards can be bought from authorized resellers. The resellers linked from the top-up center in the app are the ones authorized at any given time; that link is the authoritative list. Buying a card from a reseller is a contract between you and that reseller: the price, currency, payment methods, receipts or invoices, delivery, and any refund of a card you have not redeemed are governed by the reseller's own terms. EtherFun Lab is not a party to that sale, does not process your payment and does not receive your payment details.
Resellers set their own prices, which may differ from the prices shown in the app. Redeeming a card credits your account with the points value of that card, whatever you paid for it. Codes are redeemed in the top-up center while signed in to an account; the anonymous demo cannot redeem them.
Anyone who has a card's code can redeem it, and each code can be redeemed only once. Keep a code confidential until you have redeemed it. We do not replace codes that are lost, stolen, disclosed or redeemed by someone else. Once a code is redeemed, the points are subject to the rules in this Section: they have no cash value, cannot be transferred and are non-refundable except where applicable law requires.
We may refuse to honor or void a code, and reverse the points credited from it, if the code was obtained through fraud or theft or if the payment for it was charged back, reversed or refunded. Codes bought from anyone other than an authorized reseller are bought at your own risk: they may already have been redeemed or voided, and we do not replace them. For payment, delivery, receipts or refunds of a card, contact the reseller you bought it from; for problems redeeming a code, contact us at the email address in the Contact section.
Tips are voluntary payments in cryptocurrency sent to EtherFun Lab, not to character creators. A tip buys no goods or services and is final once broadcast. Any amount shown in a fiat currency next to a tip is a display convention, not a valuation or exchange rate. The amount of a tip may be shared with the companion to shape its reply.
7. Virtual items and character simulation
The Service includes virtual items you can give to characters, such as food, drinks, flowers, gems or cash. Some are free; others are bought with points in the friendship shop and kept in your backpack. Virtual items exist only inside the Service. Nothing physical is delivered, and no money, goods or value passes to a character, its creator or anyone else. Items that depict cash, credit cards, gold, gems or other valuables are pictures and words, not money, payment instruments or property.
Items in your backpack follow the rules for points in Section 6: they have no cash value, cannot be transferred between accounts or exchanged back for points or money, and are non-refundable except where applicable law requires. An item leaves your backpack only when a character accepts it; a character may refuse an item. We may change the names, prices and effects of items, or withdraw them. A withdrawn item may be removed from backpacks, and the points paid for it are not refunded.
Some items depict tobacco, alcohol, medicine or herbs, and a character may be shown under their effects. These are fictional depictions within a story. They do not endorse or encourage the real use of any substance, and nothing about an item, its effect or a character's reaction is medical, dosage or health information.
Characters have simulated needs, body states, life events and relationship state that change over time and with what you do. This simulation is fictional and produced by software. It does not reflect anyone's real feelings, health or circumstances, no real person is affected by it, and you have no obligation to keep a character fed, rested or content. We may change, rebalance or reset the simulation.
8. Wallet and on-chain features
Some features (wallet sign-in, buying points with cryptocurrency, tipping) require a Solana wallet you control. By using these features you acknowledge that:
- You alone are responsible for your wallet, private keys, and seed phrases. We never receive them.
- On-chain transactions are final and irreversible. We cannot reverse a transaction once broadcast.
- Blockchain data is public; your wallet address and transaction history are visible to anyone.
- Network fees, congestion, and outages may affect transaction success and timing.
- Cryptocurrency values are volatile. We do not provide investment advice and nothing on the Service constitutes a financial recommendation.
9. Character Plaza
You can create characters and publish them to the Plaza, where other users can acquire them with points. By publishing a character you confirm that you have the rights to everything it contains, that it depicts an adult, and that it complies with Section 4.
You set the price of a character you publish. When another user acquires it, they receive a personal, non-transferable license to chat with that version of the character, and you earn points from the sale as shown in the app. The price a user pays is the price shown at the moment of purchase. A user who has acquired a character keeps the version they acquired; later versions you publish may be offered separately.
We may edit, suspend, unpublish or remove a character at any time if we believe it violates these Terms, infringes someone's rights, or harms the Service. Removal may end other users' access to it. If a character you acquired is later taken down or unpublished, the points you paid for it are not refunded. We may also adjust points balances to correct errors or abuse.
A character marketplace, if offered, would be a preview of planned on-chain trading. Nothing in it creates an offer, listing or transaction. We will update these Terms before on-chain trading of characters is enabled.
10. Voice, images, video and Telegram
Voice calls are transcribed to text and stored as part of the conversation. Image and video generation is subject to the allowances and point costs shown in the app; some capabilities are available only on certain plans. You may link a character you own to a Telegram bot; the bot is yours to operate and you are responsible for how it is used.
Some character voices come from third-party voice libraries. We do not warrant that every voice is free of third-party claims; we remove voices on notice of a valid claim.
11. Intellectual property
The Service, including the eros-engine, companion designs, the Eros brand, and the underlying software, is owned by EtherFun Lab or its licensors and is protected by intellectual-property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
You retain ownership of the text you input. By submitting content, you grant us a worldwide, royalty-free license to store, process, and display that content as necessary to operate the Service. We will not publish your conversation content to other users without your consent.
Content generated for you on the Service, including images, videos, voice and text replies, is yours to use under a personal, non-commercial license: you may keep it and share it privately or on social media, in compliance with Section 4, applicable law and the rules of the platform you share on, but you may not sell it or use it commercially. We retain a license to store, process, display and use that content to operate and improve the Service, as described in the Privacy Policy. For published characters, the license from creator to buyer is the one set out in Section 9.
12. Open source notice
The Eros engine is published as an open-source project under its own license. These Terms govern only your use of the hosted Service at eros3.ai, not your independent use of the open-source engine.
13. Third-party assets
Country flag artwork is from Flagpack by Yummygum, licensed under CC BY 4.0. No modifications.
14. Service availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, or that any particular companion, feature, or piece of content will remain available. We may change, suspend, or discontinue features at any time without liability.
15. Disclaimers
To the fullest extent permitted by law, EtherFun Lab disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content. Use of the Service is at your sole risk.
16. Limitation of liability
To the fullest extent permitted by law, EtherFun Lab and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service. Our aggregate liability for any direct damages shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100.
17. Indemnification
You agree to indemnify and hold harmless EtherFun Lab against any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.
18. Termination
You may stop using the Service at any time. Account deletion is requested by email to lab@etherfun.net and handled on the schedule in Section 5 of the Privacy Policy. We may suspend or terminate your access if you violate these Terms or if continued provision becomes commercially or legally impracticable.
On termination or deletion, unused points of every kind and any creator earnings are forfeited and are not paid out. Characters you published are removed from the Plaza; users who already acquired them keep access to the version they acquired, unless we remove the character under Section 9. If your account is deleted, your private characters, conversations and generated media are deleted on the schedule in Section 5 of the Privacy Policy.
19. Changes
We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use after the effective date constitutes acceptance of the revised Terms.
20. Governing law and disputes
These Terms are governed by the laws applicable to the place where EtherFun Lab is established and where its servers are located, without regard to conflict-of-laws principles. The parties agree to attempt in good faith to resolve any dispute informally before resorting to formal proceedings. Where required, disputes shall be brought in the competent courts of that place.
21. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and EtherFun Lab regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign these Terms without our written consent.
