Using Eros

1. Eligibility

You must be at least 18 years old to use the Service. By using it you represent that you are 18 or older, have the legal capacity to enter into these Terms, and are not barred from using the Service under the laws of your jurisdiction.

2. What Eros is

Eros provides AI-driven companion characters you can chat with. Each companion is a software construct, not a real person. Replies are generated by AI and may be inaccurate, inconsistent, or unsuitable for any particular purpose. The Affinity Mechanism (warmth, trust, intrigue, intimacy, patience, tension) reflects internal relationship state and is not a measure of any real-world quality.

Eros is not a substitute for human relationships, medical advice, mental health treatment, legal advice, or any professional service. If you are in crisis, please contact a qualified professional or a local emergency service.

3. Your account

You access the Service by signing in with Google through Supabase. You are responsible for activity under your account and for keeping your Google credentials secure. Notify us promptly if you believe your account has been compromised.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to facilitate illegal activity.
• Submit content that sexualizes minors, depicts non-consensual acts, or otherwise violates applicable law.
• Harass, threaten, or attempt to identify other users.
• Probe, scan, scrape, reverse-engineer, or interfere with the Service or its underlying systems.
• Bypass rate limits, abuse free quotas, or use automated tools to interact with the Service without our written permission.
• Impersonate any person or misrepresent your affiliation with anyone.
• Use the Service to train competing AI models without our express written consent.

We may suspend or terminate your access if we reasonably believe you have violated these rules.

5. AI-generated content

Companion replies are produced by AI and may contain errors, inappropriate statements, or fabrications. You should not rely on companion responses for factual, financial, medical, legal, or emotional guidance. We do not warrant the accuracy, completeness, or suitability of any AI-generated output.

6. Wallet and on-chain features

Some features (tipping, the character marketplace, certain identity-bound actions) require connecting a Solana wallet you control. By using these features you acknowledge that:

• You alone are responsible for your wallet, private keys, and seed phrases. We never receive them.
• On-chain transactions are final and irreversible. We cannot reverse a transaction once broadcast.
• Blockchain data is public; your wallet address and transaction history are visible to anyone.
• Network fees, congestion, and outages may affect transaction success and timing.
• Cryptocurrency values are volatile. We do not provide investment advice and nothing on the Service constitutes a financial recommendation.

7. Marketplace (preview)

The character marketplace currently shows placeholder data. Buy, list, and offer actions are previews; no real on-chain trade occurs until the marketplace launches. We will update these Terms with marketplace-specific rules before on-chain trading is enabled. Until then, no listing creates a legally enforceable offer to sell.

8. Intellectual property

The Service, including the eros-engine, companion designs, the Eros brand, and the underlying software, is owned by EtherFun Lab or its licensors and is protected by intellectual-property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

You retain ownership of the text you input. By submitting content, you grant us a worldwide, royalty-free license to store, process, and display that content as necessary to operate the Service. We will not publish your conversation content to other users without your consent.

9. Open source notice

The Eros engine is published as an open-source project at github.com/etherfunlab/eros-engine under its own license. These Terms govern only your use of the hosted Service at chat.etherfun.xyz, not your independent use of the open-source engine.

10. Third-party assets

Country flag artwork is from Flagpack by Yummygum, licensed under CC BY 4.0. No modifications.

11. Service availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, or that any particular companion, feature, or piece of content will remain available. We may change, suspend, or discontinue features at any time without liability.

12. Disclaimers

To the fullest extent permitted by law, EtherFun Lab disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content. Use of the Service is at your sole risk.

13. Limitation of liability

To the fullest extent permitted by law, EtherFun Lab and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service. Our aggregate liability for any direct damages shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100.

14. Indemnification

You agree to indemnify and hold harmless EtherFun Lab against any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.

15. Termination

You may stop using the Service at any time. You may request account deletion via henrylin@etherfun.xyz or, where available, from your account settings. We may suspend or terminate your access if you violate these Terms or if continued provision becomes commercially or legally impracticable.

16. Changes

We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use after the effective date constitutes acceptance of the revised Terms.

17. Governing law and disputes

These Terms are governed by the laws applicable to the place where EtherFun Lab is established, without regard to conflict-of-laws principles. The parties agree to attempt in good faith to resolve any dispute informally before resorting to formal proceedings. Where required, disputes shall be brought in the competent courts of EtherFun Lab's place of establishment.

18. Miscellaneous

These Terms constitute the entire agreement between you and EtherFun Lab regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign these Terms without our written consent.
